1. Introduction and Acceptance of Terms

Welcome to Luminary Studios, a premier photo studio rental service located in the vibrant heart of Ardenwood, Willow Creek Valley . These Terms and Conditions ("Terms") govern your access to and use of the Luminary Studios website, services, and any related bookings or agreements. By accessing our website or booking any of our studio spaces, equipment, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services or website.

These Terms are effective as of October 26, 2023 . Luminary Studios reserves the right to modify these Terms at any time. Any changes will be posted on this page with an updated effective date.

2. Services and Booking Policies

Luminary Studios offers rental of its photography studio spaces, including various backdrops, lighting equipment, and amenities. We also provide optional professional photography services and editing packages, which are subject to separate agreements and pricing detailed on our Pricing page.

• Booking Availability: Studio availability can be checked and bookings made through our website or by contacting our booking team directly. All bookings are subject to confirmation by Luminary Studios.
• Booking Confirmation: A booking is confirmed only upon receipt of a confirmation email from Luminary Studios and any required deposit.
• Rental Periods: Studio rentals are available in hourly, half-day, and full-day blocks. Overtime charges will apply if a rental period is exceeded without prior arrangement and approval.
• Equipment Rental: When renting equipment, clients are responsible for its care and return in the same condition as received, reasonable wear and tear excepted. Any damage or loss will be charged at replacement cost.
• Studio Capacity: Each studio space has a maximum occupancy limit, which must be adhered to for safety and comfort.

3. Payment Terms

All rental fees and charges are subject to change without prior notice, except for confirmed bookings. Payment terms are as follows:

• Deposits: A non-refundable deposit of 30% of the total rental fee is required at the time of booking to secure your reservation.
• Balance Payment: The remaining balance is due in full on the day of the rental, prior to commencement of the session.
• Additional Charges: Any overtime, damages, or additional services not included in the initial booking will be billed separately and are payable immediately upon invoicing.
• Payment Methods: We accept major credit cards, bank transfers, and certified checks.

4. Cancellation and Rescheduling Policy

We understand that plans can change. However, significant notice is required to minimize disruption and accommodate other clients.

Client Cancellations:

• More than 7 days prior to booking: Full refund of the deposit minus a 10% administrative fee.
• Between 3 and 7 days prior to booking: 50% refund of the total rental fee.
• Less than 3 days prior to booking: No refund of deposit or rental fee. The full amount remains payable.

Luminary Studios Cancellations: In the unlikely event that Luminary Studios must cancel a booking due to unforeseen circumstances (e.g., studio maintenance, power outages), we will offer a full refund or the option to reschedule at a mutually agreed-upon date and time. Luminary Studios shall not be liable for any consequential damages resulting from such cancellation.

Rescheduling: Rescheduling requests are subject to studio availability and may incur an administrative fee depending on the notice period.

5. Use of Studio Facilities

Clients and their guests are expected to use the studio facilities responsibly and respectfully.

• Prohibited Activities: No illegal activities, smoking (except in designated areas), or excessive noise levels that may disturb neighboring businesses or residents are permitted.
• Studio Condition: The studio must be returned in the same clean and orderly condition as found. Any excessive cleaning required due to the client's use will be subject to an additional cleaning fee.
• Decorations and Alterations: Clients may not make any alterations, permanent or temporary, to the studio walls, floors, or fixtures without explicit written permission from Luminary Studios.
• Third-Party Vendors: If bringing external vendors (e.g., caterers, makeup artists), clients are responsible for ensuring they also adhere to these Terms.

6. Liability and Indemnification

Luminary Studios and its owners, employees, and agents shall not be held liable for any injury, loss, damage, or theft of personal property incurred by clients, their guests, or their models while on the premises, regardless of the cause. Clients agree to indemnify and hold harmless Luminary Studios from any claims, demands, or liabilities arising from their use of the studio or its facilities.

Clients are responsible for the conduct of their guests and models and agree to ensure they comply with all studio rules and these Terms.

Insurance: Clients are strongly advised to secure their own liability and property insurance for their sessions.

7. Intellectual Property and Usage Rights

All images captured within Luminary Studios are the intellectual property of the photographer who created them. Clients who engage Luminary Studios for photography services will receive usage rights as specified in their individual service agreement.

For studio rentals only, clients retain the copyright of their work. However, Luminary Studios reserves the right to use selected images from client sessions for marketing and promotional purposes (e.g., on our website, social media, brochures), provided that proper consent is obtained or the images are presented in a way that does not identify individuals without their explicit permission.

Clients are responsible for obtaining all necessary model releases and permissions for any individuals appearing in their photographs.

8. Confidentiality

Luminary Studios respects the privacy of its clients. Any confidential information shared during the course of business dealings will be kept strictly confidential, unless required by law or with the client's express consent.

This confidentiality extends to proprietary information, trade secrets, and client data. However, Luminary Studios cannot guarantee the security of data transmitted over the internet. For more details, please refer to our Privacy Policy .

9. Dispute Resolution

Any disputes arising out of or in connection with these Terms or your use of Luminary Studios' services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached through negotiation, the parties agree to submit the dispute to mediation in Ardenwood, Willow Creek Valley . If mediation is unsuccessful, the dispute shall be settled by binding arbitration in accordance with the rules of a recognized arbitration association operating in Willow Creek County, California .

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be interpreted, construed, and enforced in all respects in accordance with the laws of the State of California, USA. You agree that any legal action or proceeding arising out of these Terms or your use of Luminary Studios shall be brought exclusively in the federal or state courts located in Willow Creek County, California, and you hereby irrevocably submit to the personal jurisdiction of such courts.
